Terms of Use

1. Acceptance

By creating an account or accessing ProofTrail ("the Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.

2. Description of service

ProofTrail is a case management and client communication tool for UK mortgage brokers. It allows brokers to track deal progress, share updates with buyers and third parties, and maintain records to support FCA Consumer Duty compliance.

ProofTrail does not provide regulated mortgage advice. Nothing on this platform constitutes a recommendation to take out or not take out a mortgage product.

3. Eligibility

Broker accounts are available to FCA-authorised mortgage advisers and their support staff operating in the United Kingdom. By registering, you confirm you have the necessary authorisations to process client data for the purposes described in our Privacy Policy.

4. Your obligations

  • Provide accurate information when creating your account
  • Keep your login credentials secure
  • Only upload data you have the right to share
  • Use the Service in compliance with FCA rules and UK law
  • Not attempt to access another firm's data

5. Subscription and payment

ProofTrail offers a 14-day free trial. No credit card is required to start. After 14 days, a paid subscription is required to create new deals. Existing deal data remains accessible regardless of subscription status.

Subscriptions are billed monthly or annually via Stripe. You may cancel at any time; access continues until the end of the current billing period. Refunds are not provided for partial periods.

6. Data and confidentiality

You retain ownership of all client data you enter into ProofTrail. We process it only to provide the Service as described in our Privacy Policy. We will not access your client data except to provide support you have requested or as required by law.

7. Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. We will notify users of planned maintenance where possible. We are not liable for losses arising from downtime beyond our reasonable control.

8. Limitation of liability

ProofTrail is provided "as is". To the maximum extent permitted by law, we exclude liability for indirect, consequential, or incidental losses. Our total liability to you shall not exceed the fees paid in the 12 months preceding the claim.

9. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
